State Clinical Trials Law

The ACA requires that most, non-grandfathered, group health plans provide coverage for the routine costs when participating in clinical trials. Some states have more consumer protections. Click here for more information about clinical trials.

MD Code Ann. §15-827 – The statute applies to private insurers and other specified managed care organizations. These entities must cover treatment that is being provided in a Phase I, II, III, or IV clinical trial for either cancer or other life-threatening condition. The trial must be approved by either: (1) NIH, (2) NIH cooperative group, (3) U.S. F.D.A. in the form of an investigational new drug application, (4) U.S. Dept. of Veterans Affairs, or (5) a state IRB. Second, the facility or personnel providing the experimental treatment must be experienced. Third, a superior, non-investigational alternative must not exist. Fourth, data related to the clinical trial must provide a reasonable expectation that the treatment will be at least as effective as the non-investigational alternative. (current 7/2011)

Paid Family Sick Leave

Maryland does not have statewide paid family leave. However, employers must allow employees to accrue paid sick leave up to 40 hours per year. Employees can carry over earned hours for a maximum of 64 hours of paid leave per year.
