State Clinical Trials Law

The ACA requires that most, non-grandfathered, group health plans provide coverage for the routine costs when participating in clinical trials. Some states have more consumer protections. Click here for more information about clinical trials.

KRS § 304.17A-136 – Kentucky requires insurance companies to by for routine patient healthcare costs during a cancer clinical trial. A clinical trial is one that is approved by: NIH or an NIH approved IBR; the FDA, DOD, or the Veteran’s administration and does one of the following:Tests how to administer a health care service, item, or drug for the treatment of cancer; Tests responses to a health care service, item, or drug for the treatment of cancer; Compares the effectiveness of health care services, items, or drugs for the treatment of cancer with that of other health care services, items, or drugs for the treatment of cancer; or Studies new uses of health care services, items, or drugs for the treatment of cancer.
